Abstract

This article length review explores the recent literature on Court-Packing, including Simon's book. I submitted this to reviews in Spring, 2014. When it did not receive an offer from a leading journal, I decided to make it my contribution to the Cleveland State Law Review symposium issue on originalism and constitutional interpretation. I presented at the Review's live symposium during Spring, 2014. Presenters' articles will appear in a future issue of the Review. The Review has not, however, seen the final version of this manuscript.
